In short: those of us not currently targeted by the regime are living under the normative state, while those targeted by the regime are living under the prerogative state, mirroring Ernst Fraenkel's "dual state" that was the Nazi regime in Germany.
The unfortunate reality is that this regime gets to choose who lives under which law, which means the dividing line can move at any time. :(
